Permissions
Currently certified Pro-ACT In-service Instructors are permitted to do the following: Instruct the Sponsor’s employees respecting the philosophy, approach, and content of the Pro-ACT Training:(a) while applicant is acting in the scope of his/her employment by Sponsor and (b) when all persons receiving the In-service Training are employed by Sponsor; to reproduce and distribute the copyrighted Pro-ACT manual(s) and workbook(s) that the Applicant receives solely for use in the In-service Training; to use the trademarked name and marks of Pro-ACT, Inc. in announcing the availability of In-service Training within the Sponsoring Organization; to modify examples of persons or situations contained in the text of the Pro-ACT manuals and workbooks solely for use in the In-service Training for the purposes of relevance to Sponsor’s situation or work force, as long as purpose and principle of the example is retained.
Restrictions
All uses of the Pro-ACT, Inc. marks and materials, other than those granted above are prohibited. All Pro-ACT materials provided to Applicant, including any modifications made to those materials made by Applicant, are the intellectual property of Pro-ACT, Inc. The permission granted the certified in-service instructor to conduct the In-service Training is limited to one year from the certification date stated on Applicant’s certificate. When the Applicant conducts two complete In-service Trainings, 14-hour Pro-ACT and 4-hour Pro-ACT Restraint Certification, or one complete In-service Training plus two complete Refresher Courses, 8-hour Pro-ACT and 2-hour Pro-ACT Restraint Certification, in the first year and makes all reports required herein, his or her permission to conduct onsite In-service Training shall be automatically extended for a second one-year period. Upon the second anniversary of the date stated in Applicant’s certificate, all permissions to conduct In-service Training or to make any other use of the Pro-ACT, Inc. marks or materials shall terminate automatically. Recertification will be available to all In-service Instructors who have completed the Training and documentation requirements for two years of their certification. Recertification classes must be taken within a period of either 3 months before or 3 months after the current certification expiration date. If the Applicant ceases to be employed by Sponsor, the Applicant’s certification shall terminate automatically. It is the policy of Pro-ACT, Inc. to reinstate certification at such time as the Applicant and Applicant’s subsequent employer fully complete, sign and submit a new In-service Instructor Agreement with Pro-ACT, Inc., provided Applicant has maintained his/her certification as indicated above.
Responsibilities
Under all circumstances: In-service Training must be delivered in the order in which material is presented in the Training and the Training manuals; the Pro-ACT In-service Training must be delivered in no less than 14 hours and the Pro-ACT–Restraint Certification In-service Training in no less than 4 hours if employees are to be issued certification. Likewise, the Pro-ACT Refresher Training must be delivered in no less than 7 hours and the Pro-ACT– Restraint Certification Refresher Training in no less than 2 hours if employees are to be issued certification; it is the responsibility of the Applicant to supervise each trainee closely and carefully throughout the Training, particularly during the role-play, evasion, and manual restraint portions of the In-service Training; any employee participating in a Pro-ACT Refresher Training must have previously completed a 14-hour Pro-ACT Training. Likewise, any employee participating in a Pro-ACT Restraint Certification Refresher Training must have previously completed a 4-hour Pro-ACT Restraint Certification Training.
